"In his decision, Judge Vinson wrote: “It would be a radical
departure from existing case law to hold that Congress can
regulate inactivity under the Commerce Clause.” If Congress has
such power, he continued, “it is not hyperbolizing
to suggest that Congress could do almost anything it wanted."
That quote from NY times article this afternoon at:
http://www.nytimes.com/2011/02/01/us/01ruling.html/.
Another quote from same article:
"A second federal judge ruled on Monday that it had been
unconstitutional for Congress to enact a health care law that
requires Americans to obtain commercial insurance..."The federal Judge
is Judge Roger Vinson of Pensacola and he [quote] "ruled that the
entire health care act should fall if the appellate courts join him
in invalidating the insurance requirement."
Judge Vinson's decision will be heard at the Appellate level in
the Court of Appeals for the 11th Circuit in Atlanta.

My comments are: well, thank GOD! It is good news for citizens and it is good news for human babies also.
And very glad another federal Judge can read the plain English of the written US Constitution*! And apply it.
