The 6th U.S. Circuit Court of Appeals ruled against the pro-life group.
“We are thrilled at the opportunity to have our arguments heard at the Supreme Court and hope that not only will SBA List’s First Amendment rights be affirmed, but those of all Americans,” said Marjorie Dannenfelser, the group’s president. “The Ohio Election Commission statute demonstrates complete disregard for the constitutional right of citizens to criticize their elected officials.” And another quote: "In an interesting turn of events, the ACLU filed a brief in support of the SBA List.
“The people have an absolute right to criticize their public officials,” ACLU stated in the brief. “The government should not be the arbiter of true or false speech and, in any event, the best answer for bad speech is more speech.”
